These Terms & Conditions (“Terms”) apply to all purchases made through our website or by distance selling.
When you place an order, you are entering into a contract with Art Yard Sale, trading under Kaos Projects Ltd (“we”, “our”, “us”). By using this website or completing a purchase, you agree to these Terms.
Please read them carefully before placing your order. We recommend saving or printing a copy for your records.
All contracts are governed by English law and communicated in English. References to “in writing” include email.
1. About Us
1.1 Our website is www.artyardsale.co.uk. Art Yard Sale is a trading name of Kaos Projects Ltd, a company registered in England & Wales (Company No. 16288704). Our registered office is at 18 Tillstone Street, Brighton, BN2 0BD.​

2. Products
2.1 Images and descriptions on our website are for guidance only. Variations may occur because:

Colours may appear differently on screens compared to the actual item.

Edition numbers shown in product images are examples only.

Hand-finished works may include natural variations.
3. Personal Information
3.1 We collect and use personal data in line with our Privacy Policy, which forms part of these Terms.

3.2 In certain cases, we may be required by law to carry out identity or anti-money laundering checks using the details you provide. These checks may be carried out without your consent.
4. Forming a Contract
4.1 The website explains the steps to place an order. Please check carefully before confirming.

4.2 After placing an order, you will receive an email acknowledging receipt. This does not mean acceptance.

4.3 If a product is unavailable, discontinued, or incorrectly priced, we will notify you and cancel the order. If you have paid, you will be refunded in full (including delivery charges).
5. Changes to These Terms
5.1 We may update these Terms from time to time.

5.2 The Terms that apply are those in effect at the time of your order.

5.3 If a change is required by law, it may apply to existing orders. In this case, we will notify you and offer the option to cancel.
6. Returns & Refunds (UK Customers Only)
6.1 UK customers may cancel most online orders within 14 days of receiving their goods.

6.2 This right does not apply to bespoke, personalised, or made-to-order artworks, including timed editions and commissions.

6.3 Orders delivered outside the UK cannot be returned unless faulty.
​
6.4 Your cancellation period begins when we confirm dispatch.

6.5 To cancel, email hello@artyardsale.com with your order details. You are responsible for return shipping costs.

6.6 Refunds will be made to your original payment method. Deductions may be made if the goods are returned damaged or not in original condition.
​
6.7 Faulty or misdescribed items will be refunded in full, including delivery charges.
​
6.8 Refunds over £2,500 may take up to 30 working days to process.
7. Delivery
7.1 Delivery is complete once the products are delivered to the address provided, at which point risk passes to you.

7.2 Ownership passes once we have received full payment.
​
7.3 If packaging is visibly damaged, you should refuse delivery so it is returned to us.

7.4 If damage is found after delivery, contact us within 48 hours with photographs and your order number.
​
7.5 Standard unframed orders are usually dispatched within 7–10 working days, subject to stock.
8. International Orders
8.1 Orders delivered outside the UK may be subject to import duties or local taxes. These are your responsibilities.

8.2 Please check with your local customs authority before ordering.
​
8.3 You are responsible for ensuring that goods comply with your local import regulations.
9. Prices & Payment
9.1 Prices shown on the website are correct at the time of listing but may be updated.

9.2 UK prices include VAT where applicable. International orders are not subject to UK VAT.

9.3 Delivery charges are shown at checkout and vary depending on the product and delivery location.

9.4 If we discover an error in pricing, we will contact you before processing. If we cannot reach you, the order will be cancelled and refunded.

Payment must be received in full before dispatch.
11. Liability
11.1 We are not liable for any loss or damage caused by events outside our reasonable control.

12. Events Beyond Our Control
12.1 We will not be responsible for failing to perform our obligations if caused by events beyond our reasonable control, such as strikes, natural disasters, or transport delays.

12.2 If such an event affects your order, we will contact you as soon as possible and either:

Provide a revised delivery date, or

Cancel the order and issue a full refund.
13. Intellectual Property
13.1 All copyright, trademarks, and intellectual property rights in the website and products remain with the artist or Kaos Projects Ltd.

13.2 You may not reproduce, distribute, or exploit artworks or website content without prior written consent.
14. Prize Draws & Competitions
14.1 Any prize draws or competitions run by us will be subject to separate rules, which will be made available at the time.
15. Commissioned & Bespoke Works
15.1 Commissioned artworks, personalised pieces, or timed editions cannot be cancelled or refunded once production has begun.

15.2 Estimated delivery times for commissions will be agreed separately.
16. Promotional Offers
16.1 From time to time, we may offer promotions or discounts. These are subject to specific terms and may be withdrawn without notice.
17. Marketplace & Third-Party Sellers
17.1 Some products may be offered on behalf of third-party sellers. In these cases, we act as an agent, and your contract will be with the third-party seller.

17.2 We are not responsible for the quality or delivery of third-party goods, though we will assist where possible.
18. Complaints
18.1 If you have a complaint, please contact us at hello@artyardsale.com. We will aim to respond within 5 working days.
19. Governing Law
19.1 These Terms are governed by English law. Any disputes will be subject to the jurisdiction of the courts of England and Wales.
20. Severability
20.1 If any part of these Terms is found to be invalid, the remaining sections will continue to apply.
21. Entire Agreement
21.1 These Terms, together with our Privacy Policy, form the entire agreement between you and Art Yard Sale (Kaos Projects Ltd).
